Anyone have experince with a restaurant Parking Ticket?
Bought the wife a car but now "Parking Eye" have sent me a Ł60 parking ticket for her exceeding the parking time at a Strabucks by 3 mins. The internet seems confused in terms of wether this is easy to contest or not, so any non Zoltaneers out there with experience with this issue that can advise please. And no it's not a dogging spot she was waiting on our daughter finishing a job interview, but thanks in advance for those who wanted to throw that bit in. Cheers.

There are usually signs in Starbucks that say if you're staying longer than 2 hours then you need to give your car registration to the staff and they'll log it so that you don't get a ticket, but I think they sometimes write it on a napkin and throw it in the bin.

The letters from Parking Eye show photos of your time of arrival and departure and a sign that shows the maximum parking time, so you'd get it and think you're banged to rights, but not if you've told the spotty oik behind the counter that you're staying there longer.

They're not as easily enforced in a court as you seem to think. If they were, then they'd maximise their revenue by taking everyone to court instead of taking a miniscule number of cases that far.

Either way, your advice was to pay it. As it turns out, that was erroneous. As I said, your first port of call is always to appeal because you lose nothing by doing so. As it happens, in this case, not paying was the right approach.

On the point of ignoring them, I've done it a few times and never been pulled up, now I use the MSE template though and have always got off with that.

If I think I'm in the wrong though, I pay it because that seems fair enough.

These tickets are legally enforceable. If the time has been exceeded the contract has been broken therefore needs to be paid.

If you think otherwise then its you talking bollox. Like i said, so many people read shit like “i had one and ignored it and fuck all happened”. Yeah, that may have happened, but do you want to take the risk and trust a website poster...

Im in court on tursday over one of these as it goes, however we are defending as we supplied the driver name in the 28 day period, so its now not legally enforceable against my company.

If you were drinking in the Starbucks for most/all of that time then ring up the branch and tell them to contact the parking company and recind the ticket.

Same thing happened to me about 3 months ago and they’re basically trying to fine people who aren’t customers.

The only ones you don't ignore are from the council. The amount I've ignored over the years, even if the next one takes me to court it'd still be a net gain. Some of these hawk firms are basically run as professional money extortioners.

I have spoken to the owners of companies like parking eye.
They are starting to take people to court and are paying the fees.

Just show evidence you was a customer thats all you need.

No, don't pay, fuck them.

I got one from them. I appealed using the MSE process, was unsucessful. I then appealed to POPLA or whomever they are and I lost that too and was told to pay up.

Never heard another dickey bird from them. Not even a 'Haha, we win' letter. Nothing.

Simple fact is it will cost them at LEAST ÂŁ300 to start a county court claim and then they will have to pay someone to turn up. If you turn up and they don't then you win by default, not that it's gonna get that far.

They send out hundreds of these letters. A certain % will just pay up. That's their business plan, they know not everyone will pay. Their letters look scary but they are all computer generated sales process letters. They will stop, just bin them.

Anyone telling you to pay this is talking out of their arse.

First you appeal, that’s a no brainier given that the worst that can happen is they decline the appeal.

Secondly, use the letter I posted a link to to appeal, do it exactly as they say and then the appeal will be successful.

Or pay, without bothering to send an email, because someone on here is talking bollocks.
